homestead ['omstɛd] n. m.
ÉTYM. 1873; mot angl., « domicile, domaine familial »; de home « maison », et stead « place ».
Anglic., dr. Institution du bien de famille insaisissable (loi du 12 juillet 1909 modifiée par la loi du 7 juillet 1948).
0 Il faut (…) rendre inaliénable ou tout au moins insaisissable, sinon toute terre, du moins celle nécessaire à l'existence et au maintien de la famille. C'est ce qu'on appelle le homestead, du nom que porte cette institution aux États-Unis où elle a été établie dès 1839 (dans le Texas), mais qui tend aujourd'hui à s'acclimater dans divers pays. En France, après une quinzaine d'années d'hésitations et plusieurs projets de loi, finalement la loi du 12 juillet 1909 est venue consacrer le homestead, ou pour parler français, le bien de famille.
